Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of SupportCaptain's email management service ("Service"), operated by SupportCaptain ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

Account Registration

To use the Service, you must:

  • Be at least 16 years of age
  • Provide accurate and complete registration information
  • Have a valid Microsoft 365 account
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account. We reserve the right to refuse service or terminate accounts at our discretion.

Service Description

SupportCaptain provides an email management platform that integrates with Microsoft 365 to offer:

  • Thread-based email organization
  • Team collaboration features (assignments, comments, workflows)
  • AI-powered assistance (summarization, reply suggestions, task extraction)
  • Automation rules and workflows
  • Newsletter management and digests
  • SLA tracking and reporting

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

Microsoft 365 Integration

By connecting your Microsoft 365 account, you authorize us to:

  • Access and sync email messages from connected mailboxes
  • Read email metadata and content
  • Send emails on your behalf through Microsoft Graph API
  • Access shared mailboxes you have permissions for

You can revoke this authorization at any time by disconnecting your Microsoft 365 account in settings or through the Microsoft consent portal.

Subscription and Billing

Free Trial

New users receive a 14-day free trial with full access to features. No credit card is required to start your trial. Your trial automatically expires unless you choose to subscribe.

Paid Subscriptions

  • Pricing: Per-user, per-month pricing based on your selected plan (Starter, Pro, or Business)
  • Billing Cycle: Monthly or annual billing, charged in advance
  • Payment: Accepted via credit card or other payment methods we support
  • Auto-Renewal: Subscriptions automatically renew unless cancelled
  • Price Changes: We will notify you 30 days before any price increases

Cancellation and Refunds

  • You may cancel your subscription at any time
  • Cancellations take effect at the end of the current billing period
  • No refunds for partial months or unused portions of your subscription
  • AI credit purchases are non-refundable
  • We reserve the right to issue refunds at our discretion

AI Features and Credits

AI features are metered and subject to monthly limits based on your plan:

  • Starter: 50 AI actions per month
  • Pro: 300-500 AI actions per month
  • Business: Increased AI credits

Each AI action (summarization, reply suggestion, task extraction, etc.) consumes one credit. Credits reset at the start of each billing cycle and do not roll over.

Additional AI credits may be purchased separately. We process AI requests through third-party providers (OpenAI, GROQ) subject to their terms and availability.

Acceptable Use Policy

You agree not to:

  • Violate any applicable laws or regulations
  • Send spam, unsolicited emails, or engage in phishing
  • Harass, abuse, or harm others
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to distribute malware or harmful code
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service for cryptocurrency mining or similar resource-intensive activities
  • Share your account credentials or allow unauthorized access
  • Scrape, crawl, or use automated tools to access the Service beyond normal usage

Violation of this policy may result in immediate account suspension or termination.

Intellectual Property

Our Rights: The Service, including its design, features, code, and documentation, is owned by SupportCaptain and protected by copyright, trademark, and other intellectual property laws.

Your Rights: You retain all rights to your email content and data. By using the Service, you grant us a limited license to access, store, and process your data solely to provide the Service.

Feedback: Any suggestions, ideas, or feedback you provide about the Service becomes our property and may be used without compensation or attribution.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

Key points:

  • Your email content remains in Microsoft 365
  • We store metadata, summaries, and AI-generated content
  • All data is encrypted in transit and at rest
  • You can request data export or deletion at any time

Service Availability and Support

We strive to maintain high availability but cannot guarantee uninterrupted service. The Service may be unavailable due to:

  • Scheduled maintenance (with advance notice)
  • Emergency maintenance or security updates
  • Third-party service outages (Microsoft, AI providers, hosting)
  • Force majeure events

Support is provided via email based on your plan level (email support for Starter, priority support for Pro, dedicated onboarding for Business).

Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties regarding accuracy, reliability, or availability
  • Warranties that the Service will be error-free or secure

You use the Service at your own risk. We do not warrant that AI-generated content will be accurate, appropriate, or suitable for your purposes.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPPORTCAPTAIN SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or data loss
  • Actions of third-party service providers
  • Unauthorized access to your account

Our total liability for any claims related to the Service is limited to the amount you paid us in the 12 months prior to the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify and hold SupportCaptain harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your email content or data

Termination

By You: You may terminate your account at any time through account settings or by contacting us.

By Us: We may suspend or terminate your account if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay subscription fees
  • Engage in fraudulent activity
  • Create risk or legal exposure for us

Upon termination, your data will be deleted within 30 days. You may request a data export before termination.

Dispute Resolution

Informal Resolution: If you have a dispute, please contact us first at hello@supportcaptain.com to resolve it informally.

Governing Law: These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the Service at least 30 days before taking effect. Your continued use after changes constitutes acceptance of the updated Terms.
